Terms of Service

1. Acceptance of Terms

By accessing CureRadar (the "Service"), you agree to be bound by these Terms. If you are using this Service on behalf of a patient, you represent that you have the legal authority or explicit consent to bind that patient to these Terms.

2. Description of AI-Assisted Service

CureRadar uses Large Language Models ("AI") to analyze pathology reports and match them against clinical trial databases. You acknowledge that:

• AI Hallucinations: AI may produce inaccurate, incomplete, or "hallucinated" data. You must verify all matches with your oncologist.
• No Guarantee of Fit: A "100% Match Score" does not guarantee clinical eligibility or enrollment in a trial.
• Database Latency: Trial statuses change daily; our Radar may not reflect "closed" or "full" status in real-time.

3. Eligibility & User Responsibility

You must be 18+ to create an account. You are solely responsible for the accuracy of the documents you upload. Submitting altered or fraudulent medical records will result in immediate termination of service and potential reporting to authorities.

4. User Content & Research License

You retain ownership of your medical records. However, to provide the Service, you grant CureRadar a license to:

• Process your data using third-party AI processors (e.g., Google Cloud, OpenAI).
• Anonymize and aggregate your data for the purpose of improving matching accuracy.
• Share your de-identified clinical profile with verified Clinical Trial Investigators when a match is found.

5. Fees and Trial Referral

CureRadar may provide its triage service for free or a fee. You acknowledge that CureRadar may receive "trial awareness" or "recruitment assistance" fees from clinical trial sponsors. This does not influence our "Match Score," which is purely algorithmic.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURERADAR LLC SHALL NOT BE LIABLE FOR ANY ADVERSE HEALTH OUTCOMES, FAILURE TO BE ENROLLED IN A TRIAL, OR INACCURACIES IN AI-GENERATED TRIAGE. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU TO US IN THE LAST 6 MONTHS.

7. Dispute Resolution & Mandatory Arbitration

Any dispute arising from these Terms will be settled by binding arbitrationin the State of Minnesota. You waive your right to a jury trial or to participate in a class-action lawsuit.

8. Governing Law

These Terms are governed by the laws of the State of Minnesota. If any part of these Terms is found unenforceable, the remaining sections stay in full effect.
